1. INTRODUCTION AND OUR ROLE

1.2 Our Exclusive Role as Online Marketplace Facilitator

ToursZoom provides an online technology marketplace platform that connects travelers with independent, third-party tour operators, activity providers, and excursion companies (each an “Operator”) who offer tours, activities, excursions, guided experiences, attraction tickets, and similar travel services (each an “Experience”).

CRITICAL LEGAL DISCLAIMER: ToursZoom acts exclusively as a limited-purpose technology platform, payment facilitator, and marketplace intermediary. ToursZoom does NOT act as a tour operator, travel agency, carrier, or direct service supplier. ToursZoom does NOT design, operate, manage, supervise, or execute any Experiences; does NOT provide guides, drivers, transportation, equipment, or accommodations; does NOT conduct safety inspections or enforce safety protocols; and does NOT accept any responsibility or liability for Operator performance, safety, quality, or execution.

When you complete checkout for any Experience, two legally separate contracts form simultaneously: (1) a platform services agreement between you and ToursZoom LLC governing your use of our technology and payment processing; and (2) a binding service contract directly between you and the specific Operator governing the Experience itself. ToursZoom earns service commissions paid by Operators, not Travelers.

1.3 Scope and Formation of This Agreement

These Terms of Service (“Terms”), together with your booking confirmation email(s), the specific Operator terms and conditions displayed during the checkout process for each Experience, our Privacy Policy, and any supplemental terms applicable to particular Platform features or promotions, constitute the complete and entire agreement between you and ToursZoom LLC regarding your use of the Platform and our limited marketplace services.
By (i) creating an account on the Platform, (ii) submitting any booking request, (iii) completing checkout for any Experience, or (iv) otherwise using any Platform services, you acknowledge that you have read, understood, and expressly agree to be legally bound by these Terms on behalf of yourself and every person named on your booking (including minors and additional travelers). If you are making a booking on behalf of others, you expressly represent and warrant that you have the full legal authority to bind all such persons to these Terms and agree to inform them of all applicable terms, conditions, limitations, disclaimers, and restrictions before they travel.

1.4 Information Accuracy and Error Correction

ToursZoom endeavors to ensure the accuracy of all information, pricing, availability, descriptions, itineraries, photographs, and other content displayed on the Platform. However, given the volume of third-party Operator content and dynamic pricing across thousands of global Experiences, occasional discrepancies or errors inevitably arise.
ToursZoom reserves all legal rights to correct any errors in pricing, availability, descriptions, or other information at any time, whether before or after booking confirmation, including the right to cancel any booking affected by a material pricing or availability error. You acknowledge and agree that you must independently verify all critical booking details before completing checkout. ToursZoom accepts no responsibility for errors you fail to notice or correct prior to final payment authorization.

2. AGREEMENT FORMATION

2.1 Booking Process and Contract Creation

To reserve any Experience, you must complete our secure online booking process or contact our Customer Service team during business hours. The process includes selecting your Experience, reviewing the Operator’s terms and pricing, entering accurate traveler information for all participants, and authorizing payment. Upon successful payment processing, two legally separate binding contracts form simultaneously: (a) a Platform Services Agreement between you and ToursZoom LLC governed by these Terms, and (b) an Experience Service Contract directly between you and the specific Operator governed by their displayed terms. The binding agreement exists the moment we issue electronic confirmation. Errors must be reported within 24 hours per Section 6.2.

2.2 Lead Booker Authority and Representation

The individual submitting the booking request (“Lead Booker”) acts as legal representative for all persons named on the booking, including minors. The Lead Booker expressly warrants legal capacity to enter binding contracts on behalf of all named persons, agrees to communicate all Terms and restrictions to other travelers before departure, authorizes ToursZoom to communicate exclusively with Lead Booker, and assumes financial responsibility for all payments, fees, and cancellation penalties. Minors under 18 require a parent or legal guardian acting as Lead Booker. All group bookings are treated as a single unit under Lead Booker authority.

2.3 Information Accuracy and Verification Duty

You are responsible for verifying all booking details before final payment, including Experience date, time, meeting location, participant names matching passports/ID, total pricing breakdown, cancellation policy, and Operator requirements. Once confirmed and paid, ToursZoom relies on information provided as complete and accurate. Post-confirmation corrections incur change fees per Section 10. ToursZoom accepts no liability for travel disruptions caused by information errors you failed to correct pre-checkout.

2.4 Integration of Operator Terms

Each Operator maintains independent terms and conditions specific to their Experience, displayed prominently during checkout and incorporated by reference into your direct service contract with them. These may include specific cancellation windows, participant restrictions, equipment requirements, weather contingency policies, and liability waivers. ToursZoom exercises reasonable commercial diligence selecting reputable Operators but maintains no control over, and accepts no legal responsibility for, Operator performance, safety, quality, or contractual performance. Operator terms prevail over these Platform Terms where conflicts exist regarding Experience delivery.

2.5 Changes to These Terms of Service

ToursZoom reserves rights to modify these Terms at any time. Material changes receive advance notice via prominent Platform banner and email to registered account addresses. Continued Platform use or new bookings post-change date constitutes acceptance of modified Terms. Changes do not retroactively affect confirmed bookings unless Force Majeure or fraud circumstances apply.

3. PAYMENT OBLIGATIONS

3.1 Payment Terms and Schedule

All payment terms, amounts, due dates, and installment schedules are clearly displayed during checkout for your review and acceptance before final submission. Unless the specific Experience listing specifies otherwise, ToursZoom’s standard payment terms apply as follows: Initial Deposit: Required immediately at time of booking, typically 20-40% of total price. Balance Payments: Payable according to the schedule shown at checkout, which may include installments or a single balance payment due 60 days before travel. Bookings Made 60 Days or Less Before Departure: Full payment required at time of booking.
All payments are processed through PCI-DSS Level 1 compliant payment processors. Prices displayed at checkout represent the complete total cost including (i) the Operator’s base service rate, (ii) ToursZoom’s service and platform fees, and (iii) any applicable taxes. For international currency or cross-border payments, standard currency conversion fees (typically 2-3%) may apply and display clearly before you authorize final payment. All payment authorizations constitute irrevocable instructions to charge the full displayed amounts according to the agreed schedule.

3.2 Consequences of Non-Payment or Late Payment

Failure to make any required payment by its specified due date constitutes a material breach of these Terms. ToursZoom reserves all rights to immediately suspend your booking and Platform access, automatically cancel the booking, and apply standard cancellation fees per Section 7 based on proximity to departure date at time of default. No refunds or credits issue for partially paid bookings cancelled due to payment default. Late payments trigger immediate late fees equal to 3% of the overdue amount or $25 USD (whichever greater), compounded monthly until paid in full.

3.3 Additional Fees and Non-Refundable Charges

A mandatory, non-refundable handling and processing fee of $49 USD applies to every booking processed through the ToursZoom Platform. This fee compensates ToursZoom for payment processing infrastructure, customer support operations, dispute resolution, fraud monitoring, and general Platform maintenance. The handling fee remains fully non-refundable under all circumstances, including voluntary cancellations, Operator cancellations, payment disputes, chargebacks, or Force Majeure events. Additional non-refundable fees may also apply, always displayed clearly at checkout, including Operator surcharges, destination taxes, currency conversion fees, post-booking add-ons, and change/rebooking fees per Section 10.

3.4 Chargeback Prohibition

Unauthorized credit card chargebacks, payment disputes, or similar payment retrieval attempts (except in documented cases of proven payment fraud by ToursZoom) constitute material breaches of these Terms. If you initiate any unauthorized payment dispute, you remain personally liable for the original booking amount, must reimburse ToursZoom for all chargeback processing fees and administrative recovery costs, agree to pay all reasonable attorney fees and collection costs, and face immediate account suspension. Repeated violations (2+ incidents) result in permanent account termination. ToursZoom reserves rights to pursue civil collections and all available legal remedies.

3.5 Price Accuracy, Changes, and Error Correction

ToursZoom maintains pricing across thousands of dynamic Operator Experiences sourced globally. Despite rigorous quality controls, occasional pricing discrepancies or availability errors inevitably occur. ToursZoom reserves absolute rights to correct errors in pricing, availability, or other information at any time, cancel any booking affected by material pricing discrepancies (>10% variance), and adjust rates for unsold inventory or Operator price updates. In error cases, affected Travelers receive full refund of amounts paid to ToursZoom only — no consequential damages, travel costs, or alternative booking liability.

4. TRAVEL INSURANCE

4.1 Comprehensive Coverage Recommended

All travelers using the ToursZoom Platform should obtain comprehensive travel insurance providing protection from booking date through Experience completion and return home. Recommended minimum coverage includes emergency medical transportation/evacuation (minimum $100,000 USD), medical expenses (minimum $50,000 USD), trip cancellation/interruption (100% of total trip cost), baggage loss/delay (minimum $1,000 USD), and 24/7 emergency assistance services. Numerous countries mandate proof of valid travel insurance as an entry condition. Denial of entry due to inadequate insurance documentation constitutes your sole responsibility.
Travel insurance should be purchased immediately upon receiving booking confirmation to ensure continuous protection and avoid coverage gaps. Many policies exclude pre-existing medical conditions unless declared within 14-21 days of initial trip deposit.

4.2 Consequences of Traveling Without Coverage

Choosing to travel without comprehensive insurance exposes you to catastrophic unrecoverable financial losses, including medical treatment and evacuation costs, non-refundable prepaid Operator fees, emergency accommodation charges, repatriation expenses, and legal fees. ToursZoom explicitly disclaims all liability for any losses, damages, expenses, or claims that comprehensive travel insurance would have covered. By booking through our Platform, you expressly acknowledge this risk allocation and accept full financial responsibility for all uninsured losses.

4.3 Proof of Coverage

Certain high-risk Experience Operators may require proof of insurance coverage at check-in. Failure to produce required documentation may result in denied participation with no refund from ToursZoom or the Operator.

5. ELIGIBILITY AND SPECIAL NEEDS

5.1 Age Requirements and Legal Capacity

To use the ToursZoom Platform and complete any booking, you must be at least 18 years of age and possess the full legal capacity to enter into binding contracts under applicable law. By submitting any booking request or creating an account, you expressly represent and warrant that you meet minimum age requirements (18+), you have the legal authority to act on behalf of all persons named in the booking, and all information provided is accurate, current, and complete. Minors under 18 years old require a parent or legal guardian acting as Lead Booker with explicit written consent. The adult guardian assumes full financial and legal responsibility for the minor’s participation.

5.2 Medical Conditions and Special Needs Disclosure

You must disclose all medical conditions, disabilities, allergies, dietary restrictions, pregnancy status, or other special needs that may affect your ability to safely participate in the selected Experience at the time of booking. Failure to disclose may result in booking denial or cancellation without refund, on-site participation refusal by Operator, voided liability protections and insurance coverage, and additional fees for last-minute accommodations. Many activities prohibit participation after certain weeks of pregnancy; specific Experiences display maximum weeks allowed.

5.3 Physical and Mental Fitness

You expressly warrant that all persons named on your booking possess the necessary physical, mental, and emotional fitness to safely participate in the selected Experience. Participation requirements vary widely by activity type — review specific Experience requirements displayed at checkout. Participation with undisclosed conditions constitutes breach of contract.

5.4 Accommodation of Disabilities

ToursZoom and Operators endeavor to accommodate travelers with disabilities through reasonable modifications where feasible. However, no guarantees of full accessibility can be made, activity-specific limitations apply, and service animals are subject to Operator approval and destination laws. Full disclosure at booking is essential; last-minute accommodation requests may incur additional fees and may not be possible.

5.5 Behavioral and Conduct Standards

All participants must follow all Operator instructions, maintain appropriate conduct, refrain from illegal activities or disruptive behavior, and comply with local laws and customs. Operators reserve rights to refuse service or remove disruptive participants without refund. ToursZoom accepts no liability for consequences of participant misconduct.

5.6 Changes in Health or Circumstances

If your health or circumstances change post-booking affecting ability to participate safely, you must notify ToursZoom immediately and obtain Operator approval for continued participation. Cancellation fees per Section 7 apply if participation is prohibited.

6. BOOKINGS AND CONFIRMATION

6.1 Booking Process

Booking any Experience through the ToursZoom Platform requires completing our secure online process, which includes reviewing complete Experience details, Operator terms, cancellation policy, and total pricing before final payment authorization. Upon successful payment processing, you receive an immediate confirmation email containing your unique booking reference number, complete itinerary with Operator contact details, payment receipt, meeting instructions, and a digital copy of all Terms accepted.

6.2 Mandatory Accuracy Verification

CRITICAL: You must verify every booking detail before clicking final “Confirm & Pay”: dates/times/meeting location, participant names (exact passport match), total pricing/fees/taxes breakdown, cancellation policy/deadlines, participant requirements (age/health), and Operator identity/contact information. Post-confirmation corrections incur change fees per Section 10. Errors causing travel disruptions constitute your sole responsibility.

6.3 Special Requests

Any special requests (dietary restrictions, accessibility accommodations, medical equipment) must be submitted during the booking process. Requests are noted on confirmation but NOT guaranteed; they may incur additional fees and are subject to Operator approval based on feasibility and safety. Special requests noted do not constitute a contractual promise.

6.4 Package vs. Individual Bookings

ToursZoom facilitates individual Experience bookings only, not pre-packaged combinations of transport, lodging, and tours constituting regulated travel packages. Multiple separate bookings do not create package rights or protections. Each Experience constitutes an independent Operator contract.

6.5 Confirmation as Complete Contract

Your booking confirmation email and checkout screens constitute the complete record of your agreements with ToursZoom and Operators. Keep securely for the duration of travel.

7. CANCELLATIONS

7.1 Cancellation Procedure and Notice Requirements

All cancellations must follow our formal written procedure to be effective. Verbal cancellations, phone requests, or account deletions do NOT constitute proper notice. To cancel: Submit written cancellation request through our secure online contact form here. Include complete booking reference number, all participant names, and travel dates. Cancellation effective date equals the timestamp of form submission receipt. Outside business hours (9AM-6PM ET Mon-Fri): Effective next business day. Automatic confirmation email sent upon receipt.

7.2 Standard Cancellation Fee Schedule

Unless the specific Experience displays stricter terms at checkout (which control), ToursZoom’s standard cancellation penalties apply: 60+ days before departure: 60% of total booking amount retained. 59-30 days before departure: 75% of total booking amount retained. 29 days or fewer before departure: 100% of total booking amount retained. No-shows or late arrivals: 100% non-refundable. ALL fees calculated from original booking total including Operator rate + ToursZoom service fees + taxes + $49 handling fee.

7.3 Non-Refundable Components

ALWAYS non-refundable regardless of cancellation timing: $49 USD handling fee (all bookings), post-booking add-ons/extras purchased after initial confirmation, third-party services booked through Operators, and peak season surcharges or special event fees.

7.4 No Partial Cancellations

Entire booking must be cancelled as a single unit. Individual participant removal, date changes, or partial refunds are prohibited. All group bookings are treated as indivisible contracts under Lead Booker authority.

7.5 Operator-Initiated Cancellations

If an Operator cancels for any reason (weather, minimum numbers, emergencies, Force Majeure): Full refund automatically issues to original payment method. No ToursZoom liability for consequential damages, alternative arrangements, or travel costs. ToursZoom may suggest alternative Experiences when available. Operator cancellation does not constitute ToursZoom breach.

7.6 Cancellation Coverage Options

Certain Experiences offer optional cancellation protection purchased at checkout: Flex Cancellation provides a refund as ToursZoom credit (minus admin fee) up to 30 days prior; Flex+ Cancellation provides a cash refund option up to 30 days prior. Coverage details and limitations display during purchase.

7.7 Chargebacks as Cancellation Substitute

Using credit card chargebacks to circumvent cancellation policy constitutes material contract breach. Full fees apply per above schedule, plus additional chargeback processing fees ($35-50/incident). Legal collection action may be pursued for disputed amounts. Permanent account termination results after 2+ incidents.

7.8 Insurance Recovery

Cancellation fees may be recoverable from your travel insurance policy per insurer terms. File claims directly with your provider using ToursZoom cancellation confirmation, original booking confirmation, and proof of payment.

7.9 Refund Processing Timeline

Approved refunds process within 7-10 business days to original payment method. Credit cards: visible within 2 billing cycles. Debit cards: 3-5 business days. PayPal: immediate. No cash or check refunds.

7.10 No-Show Policy

Missing departure time or meeting point constitutes an automatic 100% forfeiture regardless of reason. Operators determine no-show status at their sole discretion.

8. OPERATOR RESPONSIBILITY

8.1 Independent Contractor Status

Every Operator offering Experiences through the ToursZoom Platform constitutes an independent business entity operating under their own management, licensing, insurance, and quality standards. Operators maintain exclusive legal responsibility and control over all aspects of Experience design, execution, staffing, safety, and customer service. ToursZoom exercises no operational control whatsoever. ToursZoom’s involvement terminates completely after payment processing — we provide no on-site supervision, safety inspections, equipment testing, personnel verification, emergency response, or performance guarantees. Your exclusive recourse for Operator issues rests directly with the Operator.

8.2 Responsibility Matrix

  • Safety: Operator — Risk assessments, safety protocols, equipment checks. ToursZoom — NOT responsible for any safety oversight.
  • Staff: Operator — Hiring, training, uniforms, conduct. ToursZoom — NOT responsible for personnel qualifications.
  • Equipment: Operator — Provision, maintenance, condition. ToursZoom — NOT responsible for gear quality/safety.
  • Timing: Operator — Departure delays, itinerary changes. ToursZoom — NOT responsible for schedule adherence.
  • Weather: Operator — Cancellation decisions, alternatives. ToursZoom — NOT responsible for weather impacts.
  • Emergencies: Operator — Medical response, evacuation. ToursZoom — NOT responsible for crisis management.
  • Compliance: Operator — Local laws, permits, licenses. ToursZoom — NOT responsible for regulatory violations.

8.3 Traveler On-Site Obligations

Your responsibilities during the Experience include arriving 15+ minutes early at the exact meeting point, bringing all required items (ID/passport, confirmation, insurance proof, weather gear, Operator-specified equipment), following Operator staff instructions, and notifying Operator immediately of medical issues. Late arrival (missing roll call) constitutes an automatic no-show with 100% forfeiture.

8.4 Operator Cancellation Rights

Operators maintain absolute discretion to cancel or postpone Experiences due to unsafe weather, insufficient participant numbers, equipment failure, staff issues, government restrictions, or Force Majeure events. Full refund issues through ToursZoom. No ToursZoom liability for alternatives, consequential costs, or disappointment.

8.5 No Vicarious Liability

Operators constitute independent contractors, not ToursZoom agents, employees, or joint venturers. Their acts, omissions, negligence, misconduct, bankruptcy, or insolvency create no vicarious liability for ToursZoom under any legal theory.

8.6 Direct Operator Communication

All on-site issues (equipment problems, medical emergencies, itinerary questions) must go directly to Operator staff. ToursZoom provides no on-site support. Post-Experience complaints follow Section 11 process.

9. COMMUNICATIONS

9.1 SMS Text Messaging Consent (TCPA Compliant)

By providing any telephone number during registration or booking, you provide express written consent under the Telephone Consumer Protection Act (TCPA) to receive automated and manual text messages from ToursZoom. Transactional messages include booking confirmations, payment receipts, Experience reminders, schedule changes, and support responses. Marketing messages (promotional offers, new Experience notifications) are optional — reply STOP to any SMS to unsubscribe from marketing messages; transactional messages continue. Reply HELP for assistance. Standard message and data rates may apply.

9.2 Email Communications

You must maintain an accurate email address in your account. ToursZoom sends mandatory transactional emails including booking confirmations, payment receipts, Operator communications, policy changes, cancellation confirmations, and legal notices. Marketing emails contain one-click unsubscribe links compliant with the CAN-SPAM Act. Check spam/junk folders — ToursZoom is not responsible for emails filtered by providers.

9.3 Platform Notifications and Response Times

Account dashboard displays real-time notifications including messages from Operators, payment alerts, Experience changes, and account security alerts. ToursZoom strives for prompt responses but makes no guarantees regarding response times. Email target: 24 business hours. Phone support: business hours only (M-F 9AM-6PM ET). During Experiences, contact Operators directly — ToursZoom provides no real-time on-site support.

10. LIABILITY LIMITATIONS

10.1 No Liability for Third-Party Operator Services

TO THE FULLEST EXTENT PERMITTED BY LAW, TOURSZOOM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS (COLLECTIVELY “TOURSZOOM PARTIES”) EXPRESSLY DISCLAIM ALL LIABILITY arising from any Experiences provided by independent third-party Operators, including personal injury, illness, disability, or death; Operator negligence, misconduct, or service failures; defective or unsafe equipment, vehicles, or facilities; inadequate safety protocols or emergency preparedness; third-party services; lost, stolen, or damaged property; and Operator insolvency or licensing failures. Your exclusive recourse rests directly with the Operator.

10.2 Express Assumption of All Risks

Travel and activity participation involve inherent, unforeseeable, and severe risks. By booking any Experience, you voluntarily and knowingly assume ALL risks associated with international travel and third-party operated activities, including but not limited to physical injury risks from adventure activities, health risks from infectious diseases, environmental hazards, political instability, and Operator performance variability. You waive all claims against ToursZoom Parties for any injury, damage, loss, or death however caused.

10.3 Strict Monetary Liability Cap

TOURSZOOM PARTIES’ MAXIMUM AGGREGATE LIABILITY SHALL NEVER EXCEED the total amount you actually paid ToursZoom for the specific booking giving rise to the claim, regardless of legal theory (contract, tort, negligence, strict liability, etc.).

ABSOLUTELY NO LIABILITY for indirect, consequential, incidental, special, punitive, or exemplary damages, lost profits, business interruption, emotional distress, travel costs, alternative arrangements, or third-party claims.

10.4 Force Majeure — Complete Liability Exclusion

ToursZoom Parties accept zero liability for any service disruptions, cancellations, delays, or performance failures caused by Force Majeure Events including but not limited to natural disasters, pandemics/epidemics, government actions, labor actions, terrorism/war/civil unrest, utility failures, and supplier failures. Full refund (if applicable) constitutes complete remedy.

10.5 Additional Liability Exclusions

ToursZoom disclaims all liability for Operator content accuracy (itineraries, photos, descriptions, reviews), pricing errors corrected post-booking, meeting point inaccuracies, consequences of incorrect booking information you provided, failure to verify requirements, missing required documents, non-compliance with Operator instructions, alcohol or drug impairment during Experiences, and Platform technical failures (aggregate liability capped at $100 USD or amounts paid, whichever lower).

10.6 Complete Liability Release

You, for yourself and all booking participants, heirs, executors, and assigns, HEREBY RELEASE AND FOREVER DISCHARGE ToursZoom Parties from all claims, demands, losses, damages, expenses, or liabilities whatsoever arising from Platform use or Operator services, whether known or unknown, foreseen or unforeseen, however caused.

11. PASSPORT, VISA, HEALTH & IMMIGRATION REQUIREMENTS

11.1 Your Exclusive Responsibility for Documentation

It is YOUR sole and exclusive responsibility to ensure all persons named on your booking — including minors, who each require individual passports and any required child visas — possess valid, current travel documentation meeting ALL requirements of every country visited, transited through, or returned from. This includes valid passports (minimum 6 months beyond planned return date), all required entry and transit visas, vaccination records and health declarations per destination mandates, insurance proof meeting entry minimums, and customs declarations. ToursZoom provides general guidance only — NOT personalized travel advice. You must verify requirements through official sources (U.S. Department of State: travel.state.gov, CDC: cdc.gov/travel, destination embassies). Requirements change frequently — check 14+ days before departure and monitor continuously during multi-destination trips.

11.2 Denied Boarding, Entry, or Participation

ToursZoom accepts ABSOLUTELY NO RESPONSIBILITY if you cannot board flights, enter destination countries, participate in booked Experiences, or return home due to documentation deficiencies. Consequences include full forfeiture of all prepaid amounts, additional transportation and accommodation costs, visa overstay fines, and deportation expenses — all your sole financial responsibility. NO REFUNDS ISSUED under any circumstances. You agree to indemnify and reimburse ToursZoom for any fines, penalties, or losses we incur due to your documentation failures.

11.3 Name Matching Requirements

Participant names MUST MATCH EXACTLY passport/ID spelling and format. Name corrections post-booking constitute ticket changes at 100% new fare plus fees. Mismatched names risk automatic boarding denial.

12. DISPUTE RESOLUTION

12.1 Governing Law and Jurisdiction

These Terms and any dispute arising from your use of the ToursZoom Platform shall be governed exclusively by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. Venue for all legal actions lies exclusively in state or federal courts located in Fulton County, Georgia. You hereby irrevocably consent to the personal jurisdiction of said courts and waive any objection to venue or inconvenience of forum.

12.2 Mandatory Binding Arbitration

Except as expressly provided below, ALL disputes between you and ToursZoom LLC shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration specifics: single arbitrator selected per AAA procedures, location in Fulton County, Georgia (or virtual if both parties agree), English language proceedings, discovery limited to AAA Commercial Rules, costs split equally unless you demonstrate financial hardship. The arbitration decision is final, binding, and non-appealable except on limited statutory grounds.

12.3 Complete Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TOURSZOOM WAIVE ANY RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE PROCEEDING, PRIVATE ATTORNEY GENERAL ACTION, OR MULTI-CLAIMANT ARBITRATION against each other. All claims must proceed on individual basis only. No consolidation of claims or claimants permitted.

12.4 Exceptions to Arbitration

Mandatory court jurisdiction applies to intellectual property claims (copyright, trademark, patent infringement), requests for injunctive relief against Platform abuse, data breaches, or fraud, and small claims actions under applicable Fulton County limits ($15,000 maximum).

12.5 Pre-Dispute Notice Requirement

NO CLAIM, SUIT, OR ARBITRATION MAY BE FILED unless you first provide formal written notice to: ToursZoom LLC Legal Department, [Your Georgia Business Address], Fulton County, Georgia [ZIP], via Certified Mail and email to legal@tourszoom.com. Notice must include your complete name, booking reference, contact information, specific factual allegations, exact damages claimed, and supporting documents. ToursZoom has a 30-day cure period. 12.6 Jury Trial Waiver

YOU AND TOURSZOOM IRREVOCABLY WAIVE ANY RIGHT TO JURY TRIAL in any court action permitted under these Terms.

12.7 Additional Arbitration Provisions

Arbitration and class waiver provisions survive termination of your account, cancellation of bookings, or expiration of these Terms. All arbitration proceedings are confidential — no press releases, social media posts, or public statements regarding disputes are permitted. If the arbitration provision is found invalid, the class action waiver survives independently. Prevailing party is entitled to reasonable attorney fees and costs in any permitted court action. Claims against Operators follow their terms and local law; ToursZoom provides no mediation between Travelers and Operators.

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms, together with your booking confirmation email, Operator-specific terms accepted at checkout, our Privacy Policy, and any applicable supplemental terms, constitute the complete agreement between you and ToursZoom LLC regarding your use of the Platform. These documents supersede all prior negotiations, discussions, or agreements between the parties.

13.2 Severability

If any provision of these Terms is held invalid or unenforceable, such provision shall be reformed to the minimum extent necessary to render it valid while preserving its original intent. All remaining provisions continue in full force and effect.

13.3 No Waiver

No failure or delay by ToursZoom to exercise any right under these Terms constitutes a waiver thereof. All rights and remedies are cumulative and not exclusive of any other remedies provided by law.

13.4 Assignment

ToursZoom may freely assign its rights and obligations under these Terms to any successor, affiliate, or third party without notice. You may not assign any rights without ToursZoom’s prior written consent.

13.5 Force Majeure

ToursZoom shall have no liability for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, government restrictions, wars, terrorism, civil unrest, strikes, supplier failures, internet outages, or power failures.

13.6 Third-Party Beneficiaries

Operators, payment processors, affiliates, and licensors are express third-party beneficiaries of these Terms with full rights to enforce applicable provisions directly against you.

13.7 Electronic Communications

You expressly consent to electronic communications (email, SMS, Platform notifications) as legally binding as hard copy, and to electronic signatures (checkout checkboxes, account registration) having the same legal effect as handwritten signatures.

13.8 Interpretation

Headings are for convenience only with no legal effect. “Including” means “including without limitation.” Time references use Eastern Time unless otherwise specified. No partnership, joint venture, agency, or employment relationship exists between the parties.

13.9 Survival

Provisions that by their nature should survive termination — including liability limits, arbitration, class waiver, payment obligations, indemnification, and disclaimers — shall survive account deletion, booking cancellation, or Terms termination.

13.10 Export Controls

You agree not to use Platform services in violation of U.S. export controls, sanctions, or prohibited destinations lists.
