These Terms of Service (“Terms”) govern your use of the ToursZoom marketplace. By using the Platform, creating an account, or completing checkout, you agree to be bound by these Terms.

1. Introduction and our role

1.1 Who we are

We are ToursZoom LLC, a Georgia limited liability company with principal place of business at Georgia, United States (“ToursZoom,” “we,” “us”). ToursZoom operates tourszoom.com, any related mobile applications and APIs, the booking engine, and all related services (the “Platform“).

1.2 Marketplace facilitator role

ToursZoom is an online marketplace connecting travelers with independent tour operators, activity providers, and excursion companies (“Operators“) who offer tours, activities, attraction tickets, multi-day itineraries, and similar services (“Experiences“).

ToursZoom is a marketplace facilitator and limited payment collection agent of the Operator. ToursZoom does not operate, supervise, or deliver any Experience. We do not provide guides, drivers, transportation, equipment, or accommodations, and we do not enforce on-site safety protocols. ToursZoom conducts a documented pre-listing review of each Operator (business credentials, licenses, insurance, reputation) as an internal quality measure — it is not a guarantee, warranty, or continuing supervision program.

1.3 The two contracts

When you complete checkout, two separate contracts form simultaneously:

  1. A Platform Services Agreement between you and ToursZoom LLC, governed by these Terms.
  2. An Experience Service Contract directly between you and the Operator, governed by the Operator’s published terms.

ToursZoom earns service commissions paid by Operators, not by you. The total price you pay is collected by ToursZoom as agent of the Operator and remitted net of commission and processing fees.

1.4 Scope and changes

These Terms incorporate by reference the, Privacy Policy, Cookie Policy, the Operator’s published terms displayed at checkout, your booking confirmation email, and any supplemental terms for particular features or promotions.

We may modify these Terms. Material changes will be announced by Platform banner and email. Continued use after the change date constitutes acceptance. Changes do not retroactively affect a confirmed booking unless required by law, by a fraud or force-majeure event, or with your express consent.

2. Eligibility

2.1 Geographic availability

Seller-of-Travel exclusions. ToursZoom is not currently registered as a Seller of Travel in California, Florida, Hawaii, or Washington. We do not accept bookings from residents of, or with billing addresses in, these four states. Bookings affected will be canceled and fully refunded.

EEA, Switzerland, and United Kingdom. We do not currently offer services to residents of these regions. Visitors may browse; checkout is blocked.

Sanctioned jurisdictions. We do not facilitate bookings to or from jurisdictions comprehensively sanctioned by OFAC (currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine). You represent you are not a person on any US sanctions list and are not booking on behalf of one.

2.2 Age, capacity, and the Lead Booker

You must be at least 18 years old with legal capacity to enter binding contracts. Minors may travel on a booking made by a parent or legal guardian acting as Lead Booker. The Lead Booker is the legal representative for every person named on the booking, warrants authority to bind them, agrees to inform them of these Terms and the Operator’s terms, authorizes ToursZoom to communicate exclusively with the Lead Booker about the booking, and assumes financial responsibility for all payments and penalties. All group bookings are treated as a single indivisible unit under Lead Booker authority.

2.3 Medical and special-needs disclosure

You must disclose at the time of booking any medical condition, disability, allergy, dietary restriction, pregnancy, or special need that could affect safe participation. Failure to disclose may result in booking denial, on-site participation refusal, voided liability protections, or additional fees. You represent that every person on your booking has the necessary physical, mental, and emotional fitness for the booked Experience.

2.4 Account accuracy

You agree to provide accurate, current, and complete information and to keep it updated. ToursZoom may suspend or terminate accounts based on materially inaccurate information.

3. Booking, payment, and pricing

3.1 Booking process

Complete the secure online checkout or contact Customer Service during business hours. On successful payment, you receive a confirmation email with your booking reference, itinerary, payment receipt, meeting instructions, and a copy of the accepted terms.

3.2 Verify before confirming

Before clicking “Confirm & Pay,” verify: dates, times, and meeting location; participant names (must match passport/ID exactly); total price with all fees and taxes; cancellation policy and deadlines; participant requirements; and Operator identity. Post-confirmation corrections may incur change fees. Errors you fail to identify pre-checkout are your responsibility.

3.3 Payment terms

All payment terms are displayed at checkout. Unless the listing specifies otherwise: initial deposit 20–40% at booking; balance due per the schedule shown at checkout (typically 60 days before travel); full payment at booking for trips 60 days or fewer from departure. All payments are processed by PCI DSS-compliant processors. Authorizing payment provides irrevocable instructions to charge the displayed amount per the agreed schedule.

3.4 Currency, non-payment, chargebacks, errors

Currency. Prices display in the currency you select. Currency conversion fees (typically 2–3%) are disclosed before you authorize payment.

Non-payment. Failure to make a required payment by its due date is a material breach. ToursZoom may suspend Platform access, automatically cancel the booking, and apply the Operator’s cancellation policy. No refunds issue for partially-paid bookings canceled due to payment default. Late payments may incur late fees of 3% of the overdue amount or $25 USD, whichever is greater.

Chargebacks. Unauthorized chargebacks against legitimate, disclosed bookings are a material breach. You remain liable for the original amount, may be charged chargeback processing and recovery fees, and repeated incidents (two or more) result in permanent account termination. This does not affect your legitimate dispute rights in cases of proven payment fraud by ToursZoom.

Pricing errors. We may correct pricing or availability errors and cancel any booking affected by a material pricing discrepancy (typically more than 10%). Affected travelers receive a full refund of amounts paid; no consequential damages are payable.

4. Travel insurance

We strongly recommend that every traveler obtain comprehensive travel insurance covering the booking period through return home. Recommended minimum coverage: emergency medical transportation and evacuation $100,000; medical expenses $50,000; trip cancellation/interruption 100% of trip cost; baggage $1,000; 24/7 emergency assistance. Many countries require proof of insurance as a condition of entry. Purchase insurance immediately upon booking confirmation — many policies exclude pre-existing conditions unless declared within 14–21 days of the initial deposit.

Traveling without insurance exposes you to catastrophic unrecoverable losses (medical, evacuation, non-refundable prepaid fees, emergency accommodation, repatriation). ToursZoom disclaims liability for losses that comprehensive travel insurance would have covered. Certain high-risk Operators may require proof of insurance at check-in.

5. Travel documentation and entry requirements

It is your sole responsibility to ensure every person on your booking holds valid passports (typically 6+ months’ validity beyond return), all required visas, vaccination records, insurance proof, and any other documentation required by every country visited, transited, or returned from. ToursZoom provides general guidance only; verify requirements through official sources (travel.state.gov, cdc.gov/travel, or your home government’s foreign-affairs authority) at least 14 days before departure.

ToursZoom accepts no responsibility for denied boarding, entry, or participation due to documentation deficiencies. Consequences (forfeiture of prepaid amounts, additional transportation/accommodation costs, visa overstay fines, deportation expenses) are your sole financial responsibility. You agree to indemnify ToursZoom for fines, penalties, or losses we incur due to your documentation failures.

Participant names must match passport/ID exactly. Name corrections after booking constitute ticket changes at 100% new fare plus fees.

6. Changes, cancellations, and refunds

Each Experience has its own cancellation policy set by the Operator and displayed at checkout with a Flexible/Moderate/Strict badge. The full mechanics — submission method, refund timing, no-show rules, force majeure, operator-initiated cancellations, dispute escalation — are in the standalone Refund and Cancellation Policy, incorporated into these Terms by reference.

To cancel: submit a written request through tourszoom.com/contact or by email to support@tourszoom.com with your booking reference, all participant names, and travel dates. The effective date is the timestamp of receipt; submissions outside business hours are effective the next business day.

Operator-initiated cancellations: if an Operator cancels for any reason, you receive a full refund through ToursZoom. We may suggest alternatives when available but have no obligation to provide them or compensate consequential damages.

7. Operator responsibility and platform role

Every Operator is an independent business with exclusive legal responsibility and control over Experience design, staffing, safety, equipment, execution, and customer service.

Pre-listing review. ToursZoom conducts a pre-listing review of each Operator (business credentials, licenses, insurance certificates, reputation). It is a quality measure, not a guarantee of safety, quality, or continued compliance, and does not transfer Operator responsibility to ToursZoom under any legal theory. We do not provide on-site supervision, ongoing inspection, or emergency response.

INFORM Consumers Act. ToursZoom collects and verifies Operator information (business name, principal contact, country of registration) and discloses it in or near each listing as required. You may report suspicious listings or product-safety concerns at tourszoom.com/report.

Your on-site obligations: arrive at least 15 minutes early at the exact meeting point; bring all required items (passport/ID, booking confirmation, insurance proof, weather-appropriate gear, any specified equipment); follow Operator staff instructions; notify the Operator immediately of any medical issue or safety concern. Late arrival missing roll call is an automatic no-show.

Operators are independent contractors, not ToursZoom agents, employees, or joint venturers. Their acts, omissions, negligence, misconduct, bankruptcy, or insolvency create no vicarious liability for ToursZoom. All on-site issues go directly to Operator staff during the Experience — ToursZoom provides no real-time on-site support.

8. Acceptable use

You agree to use the Platform only for lawful purposes and in accordance with the Acceptable Use Policy. Prohibited conduct includes submitting false information or fake reviews; harassing Operator staff or ToursZoom personnel; circumventing the Platform to avoid fees; probing Platform security; scraping Platform content; and using the Platform on behalf of any sanctioned person. We may suspend or terminate accounts for violations.

9. Communications

You must maintain a valid email address. ToursZoom sends mandatory transactional emails (booking confirmations, payment receipts, policy changes, legal notices). Marketing emails (if any) include a one-click unsubscribe link.

If you provide a phone number, you consent under the TCPA to receive automated and manual text messages for transactional purposes (booking confirmations, reminders, schedule changes, support responses). Marketing SMS requires a separate opt-in; reply STOP to unsubscribe. Standard message and data rates may apply.

During an Experience, contact the Operator directly. ToursZoom targets a 24-business-hour email response window; phone support runs M–F 9 AM – 6 PM ET (excluding US federal holidays).

10. Liability and risk

10.1 No liability for Operator services

To the fullest extent permitted by law, ToursZoom LLC and its officers, directors, employees, agents, affiliates, and licensors (collectively “ToursZoom Parties”) expressly disclaim all liability arising from Experiences provided by independent third-party Operators, including personal injury, illness, disability, or death; Operator negligence, misconduct, or service failures; defective or unsafe equipment, vehicles, or facilities; inadequate safety protocols or emergency preparedness; third-party services provided as part of the Experience; lost, stolen, or damaged property; and Operator insolvency or licensing failures. Your exclusive recourse for issues with an Operator’s Experience rests directly with that Operator.

10.2 Assumption of risk

Travel and activity participation involve inherent, unforeseeable, and sometimes severe risks. By booking an Experience, you voluntarily and knowingly assume all risks associated with travel and third-party-operated activities, and you waive all claims against ToursZoom Parties for any injury, damage, loss, or death however caused, except as provided in Section 10.4.

10.3 Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF TOURSZOOM PARTIES UNDER OR ARISING FROM YOUR USE OF THE PLATFORM OR ANY BOOKING SHALL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO TOURSZOOM FOR THE BOOKING GIVING RISE TO THE CLAIM, regardless of the legal theory (contract, tort, negligence, strict liability, statute, or otherwise).

TOURSZOOM PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, including lost profits, business interruption, emotional distress, travel costs, alternative arrangements, or third-party claims, regardless of whether ToursZoom was advised of the possibility.

10.4 Carve-outs and force majeure

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by applicable law, including fraud or fraudulent misrepresentation by ToursZoom, willful misconduct or gross negligence by ToursZoom, or death or personal injury caused by ToursZoom’s own negligence.

ToursZoom Parties accept no liability for service disruptions or performance failures caused by force majeure events (natural disasters, pandemics, government actions, labor actions, terrorism, war, civil unrest, utility failures, supplier failures). A full refund where applicable constitutes the complete remedy.

11. Voluntary dispute mediation (accommodation, not warranty)

From time to time, ToursZoom’s customer-support team may, at our sole discretion and as a voluntary accommodation, attempt to mediate disputes between you and an Operator — for example, by communicating with the Operator on your behalf, requesting an alternative Experience, or issuing a refund of amounts you paid to ToursZoom within Section 10.3’s cap.

Any mediation by ToursZoom is voluntary. We may decline to mediate or end mediation at any time. Mediation does not guarantee any outcome, transfer the Operator’s obligations to ToursZoom, waive Section 10’s limitation of liability, constitute an admission of liability, or make ToursZoom an agent or co-provider of the Operator’s Experience. A refund issued in mediation is an accommodation, not damages. Mediation does not replace your direct recourse against the Operator.

12. Dispute resolution

12.1 Governing law and venue

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws principles. Subject to the arbitration provisions below, exclusive venue for any court proceeding lies in the state or federal courts located in Fulton County, Georgia. You consent to personal jurisdiction in those courts.

12.2 Informal resolution first

Before initiating arbitration or filing any claim, you agree to send written notice describing the dispute, the relief sought, and supporting documents to ToursZoom LLC. 8735 Dunwoody Place Ste N, Atlanta, GA 30350 , or by email to admin@tourszoom.com (or via the form at tourszoom.com/legal-notice). Notices must include your full name, booking reference, contact information, factual allegations, the relief sought, and supporting documents. ToursZoom has 30 days from receipt to attempt informal resolution. Filing arbitration or court action before the 30-day cure period expires is grounds for dismissal.

12.3 Mandatory binding arbitration

Except as carved out in Section 12.5, all disputes between you and ToursZoom LLC shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, the AAA Consumer Due Process Protocol. Single arbitrator; seat in Augusta or another mutually agreed Georgia location (or virtual if both parties agree); proceedings in English; costs allocated per AAA Consumer rules (you may request a fee waiver from AAA on demonstrated financial hardship); final, binding, and non-appealable except on narrow statutory grounds.

12.4 Class action waiver

You and ToursZoom waive any right to participate in a class action, collective action, representative proceeding, private attorney general action, or mass or multi-claimant arbitration. Claims must proceed individually. If a court finds the class-waiver portion unenforceable, the entire arbitration agreement (other than this waiver) is severable and the parties proceed in court — except that the class waiver itself survives as a court-applied limit on representative claims.

12.5 Carve-outs from arbitration

These may be brought in court rather than arbitration: intellectual property claims (copyright, trademark, patent, trade secret); injunctive relief against Platform abuse, data breach, or fraud; and small claims within the limits of the Georgia magistrate court (currently $15,000).

12.6 30-day arbitration opt-out

You may opt out of the arbitration agreement and class waiver in Sections 12.3 and 12.4 by sending written notice to admin@tourszoom.com with subject “Arbitration Opt-Out” within 30 days of first accepting these Terms. Include your full name, the email on your account, and a clear opt-out statement. Opting out does not affect any other provision.

12.7 Jury trial waiver and survival

You and ToursZoom irrevocably waive any right to jury trial in any court action permitted under these Terms. Arbitration proceedings are confidential. The arbitration agreement, class waiver, jury-trial waiver, and limitation of liability survive termination, account deletion, or expiration of any booking. The prevailing party in any permitted court action is entitled to reasonable attorney fees and costs.

13. General provisions

Entire agreement. These Terms together with the documents referenced in Section 1.4 constitute the complete agreement and supersede all prior negotiations.

Severability. If any provision is held invalid, it shall be reformed to the minimum extent necessary to render it valid while preserving its intent; remaining provisions continue in full force.

No waiver. No failure or delay in exercising any right waives that right. Rights and remedies are cumulative.

Assignment. ToursZoom may assign these Terms to any successor or in connection with a merger, acquisition, or sale of assets. You may not assign without our prior written consent.

Third-party beneficiaries. Operators, payment processors, affiliates, and licensors are express third-party beneficiaries with the right to enforce applicable provisions directly against you.

Electronic communications and signatures. You consent to electronic communications (email, SMS, Platform notifications) and to electronic signatures (checkout checkboxes, account registration), which have the same legal effect as handwritten signatures.

Interpretation. Headings are for convenience only. “Including” means “including without limitation.” Time references use Eastern Time unless specified.

Survival. Provisions that by their nature should survive termination — including limitation of liability, arbitration, class waiver, payment obligations, indemnification, and disclaimers — survive account deletion, booking cancellation, or Terms termination.

Export controls. You agree not to use the Platform in violation of US export controls or sanctions and represent that you are not a person on any US sanctions list.

ToursZoom is a booking intermediary that connects travellers with independent tour operators. ToursZoom does not operate, conduct, or supervise any tours. All tours are provided by third-party operators who are solely responsible for the travel experience, safety, and services delivered.
